2) Scope and Important Pharmacy Privacy Note (HIPAA)

Some information you provide to us through the Site may be considered health information, including Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). HIPAA generally regulates how covered entities (including many pharmacies) use and disclose PHI.  

This Site Privacy Policy is not a substitute for our HIPAA Notice of Privacy Practices (NPP). Where required, our NPP describes in detail how we may use and disclose PHI and your rights regarding PHI. HIPAA also has specific rules for what an NPP must contain and how it must be distributed.

We collect information in three main ways: (A) information you provide, (B) information collected automatically, and (C) information from third parties.

A) Information You Provide

Depending on how you interact with the Site, you may provide:

  • Newsletter information (name, email) if you sign up for newsletters.  
  • Prescription-related information when using “Transfer a Prescription” or similar forms, which may include date of birth, pharmacy details, medication names, Rx number(s), and notes.  
  • Any other content you submit to us through forms, uploads, or messages.

B) Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect:

  • Device and browser data (IP address, browser type, operating system, device identifiers)
  • Usage data (pages viewed, links clicked, time spent, referring URLs)

C) Information From Third Parties

  • App and platform providers if you use third-party refill/account tools (for example, the Site references the RX365 app).  Third-party services have their own privacy policies; we are not responsible for their practices.

  • Protect against fraud, abuse, and security incidents.
  • Comply with applicable laws, regulations, and professional obligations.

5) How We Share Information

We do not “sell” personal information in the traditional sense. We may share information in the following cases:

  1. Service ProvidersWe share information with vendors who help us run the Site or provide services (for example, hosting, form tools, spam protection, analytics, email delivery). They are permitted to use the information only to provide services to us.
  2. Pharmacy Operations and Care PurposesIf you submit prescription-related information, we may use and disclose it as needed to provide pharmacy services, coordinate care, verify information, or contact your prior pharmacy, subject to applicable law and our HIPAA obligations where applicable.  
  3. Legal and SafetyWe may disclose information if we believe it is necessary to:

  • protect rights, safety, and security of patients, customers, and our business.
  1. Business TransfersIf we undergo a merger, acquisition, reorganization, or sale of assets, information may be transferred as part of that transaction.

6) Cookies, Analytics, and Similar Technologies

We use cookies and similar tools to:

  • enable Site functionality,
  • remember preferences,
  • understand Site usage and performance,
  • help with security and spam prevention.

You can manage cookies via your browser settings. Blocking some cookies may impact Site functionality.

Do Not Track / Global Privacy Control: Some browsers offer “Do Not Track” signals and Global Privacy Control. Because there is no consistent industry standard for responding, we may not respond to all such signals.

8) Marketing Communications (Email and Text)

Email

If you opt in to promotional emails, you can opt out at any time by using the unsubscribe mechanism included in those messages. The FTC’s CAN-SPAM guidance requires a clear opt-out method in commercial emails.  

Text Messages

If we offer SMS/text messaging, we will obtain the appropriate consent before sending marketing texts. Under the TCPA, marketing texts generally require prior express written consent, and you must be able to opt out.  

Message and data rates may apply. Message frequency varies. You may opt out by replying STOP (or any other method described at sign-up).

9) Data Retention

We retain personal information for as long as reasonably necessary for:

  • the purposes described in this Policy,
  • legal/regulatory requirements (including pharmacy record requirements, where applicable),
  • resolving disputes and enforcing agreements.

10) Children’s Privacy

The Site is not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us and we will take appropriate steps.

11) Your Privacy Rights (Utah and Other U.S. Residents)

  • data portability,

Utah Consumer Privacy Act (UCPA): Utah’s consumer privacy law became effective December 31, 2023.  

If the UCPA applies to our business and your data, you may request access, deletion, or portability, and opt out of targeted advertising or sales of personal data, as defined by law.

12) Third-Party Links and Tools

The Site may link to third-party sites or services (including app stores and pharmacy app platforms). For example, the Site references the RX365 mobile app and links to Apple’s App Store and Google Play.  

We do not control third-party privacy practices. Review their policies before providing information.

13) Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated” date above will reflect changes. Material changes will be posted on this page.
